These Terms of Service, together with our Privacy Policy and any community guidelines we post (collectively, the "Terms"), govern your access to and use of our website, apps, and related services and content (the "Service").
BY ACCESSING OR USING THE SERVICE, WHETHER AS A GUEST OR A REGISTERED MEMBER, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY, AND YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THEM. No persons under the age of 18 may directly or indirectly use the Service for any reason.
Unlike many platforms, curious.fun requires members to complete identity verification, which may include submitting a photo and a real-time selfie that is matched against that photo to confirm you are a real person and not using a stolen or AI-generated image. By using the Service, you agree to complete verification truthfully and not to circumvent, falsify, or assist others in circumventing the verification process.
Verification is designed to reduce bots, fake profiles, and impersonation. However, verification confirms only that an account is associated with a real person; it is not a criminal background check, a guarantee of any member's identity, character, intentions, health, or safety, and it does not make us responsible for the conduct of any member. How we handle verification images is described in our Privacy Policy.
WE ARE NOT RESPONSIBLE FOR YOUR USE OF THE SERVICE OR FOR THE ACTIONS OF OTHER MEMBERS WITH WHOM YOU EXCHANGE INFORMATION OR HAVE CONTACT, WHETHER ONLINE OR OFFLINE. We do not conduct criminal background screenings and we do not verify members' health, physical condition, or representations beyond the verification process described above. You are solely responsible for your interactions with others. Always exercise caution and good judgment, meet new people in safe public settings, and never send money or share financial information with anyone you meet through the Service. You must make your own informed decisions about using the Service in your location and assess any potential consequences.
Because we are not involved in the actual interactions between members, if you have a dispute with one or more members (whether online or offline), you release the Company and its affiliates, officers, employees, agents, and licensors from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." Residents of other jurisdictions waive any comparable statute or legal principle.
We grant you a limited, revocable, non-exclusive, non-assignable license to use the Service in compliance with these Terms. This license terminates automatically upon any violation of the Terms. You agree that all information you provide to register or otherwise use the Service is and will remain accurate, current, and complete.
If you are given or choose a username and password, you must keep them confidential and must not share your account with anyone. Your account is personal to you and may not be transferred. You agree to notify us immediately of any unauthorized use of your account or any other breach of security, and to log out at the end of each session. We may disable any username or password at any time, in our sole discretion, including if we believe you have violated these Terms.

These Terms permit you to use the Service for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Service except as incidental to normal browsing, and you must not remove or alter any copyright, trademark, or other proprietary notices.
The curious.fun name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates. You must not use them without our prior written permission. All other names, logos, and marks are the trademarks of their respective owners.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
"User-Generated Content" or "UGC" means any content you post, submit, or transmit through the Service, including posts, profile information, photos, and messages. You are solely responsible for your UGC. By submitting UGC, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and use that UGC for the purpose of operating, providing, and improving the Service.

Remember that posts and many other areas of the Service are public or semi-public. Use caution before sharing personal or identifying information, and treat other members with respect.
If you send us suggestions, ideas, or other feedback about the Service, you agree that we may use and act on that feedback for any purpose, without restriction or compensation to you, and that it is not confidential.
NO CHILD SEXUAL ABUSE MATERIAL ("CSAM") OR CONDUCT CONSTITUTING CHILD SEXUAL ABUSE OR EXPLOITATION ("CSAE") WILL BE TOLERATED ON THE SERVICE. UGC must never relate to, or be capable of being construed as relating to, children or minors in any fashion, even if directed at an adult. Any content or conduct that is, or could reasonably be construed as, CSAM or CSAE — including grooming, minor sexualization, sextortion, live-streamed abuse, or child sex trafficking — is strictly prohibited. We will ban any user involved and report them to the relevant legal authorities. There is zero tolerance for CSAM, and you will be banned regardless of whether the conduct is technically legal in your jurisdiction.

We may, but are not obligated to, review, monitor, screen, edit, refuse, or remove any UGC at any time, with or without notice, in our sole discretion. We have no obligation to store any UGC and may delete any content at any time. We are not responsible for the conduct or content of any member.
You may request to delete your account at any time through your account settings or our support page. When you confirm deletion, your posts are paused, your messages are marked as deleted, your profile is flagged for deletion, and notifications are turned off. For a limited reactivation window, you may restore your account by logging back in; after that window, associated data is permanently deleted, except where retention is required by law.
We may remove your submissions and suspend or ban your account at any time, for any reason or no reason, including for any violation of these Terms. We reserve the right to take legal action and to cooperate fully with law enforcement authorities and court orders, which may include disclosing a user's identity or other information. You waive and hold the Company harmless from any claims resulting from actions taken during or as a consequence of investigations by us or law enforcement.
The Service may link to or integrate with third-party websites, apps, or services that we do not control. We are not responsible for third-party content, services, or privacy and security practices. Use caution and review their terms and policies before engaging with them.
We respect intellectual property rights and expect our users to do the same. If you believe content on the Service infringes your copyright, please send a notice under the Digital Millennium Copyright Act ("DMCA") through our support page, including all information required by the DMCA. We will respond to valid notices and may remove infringing content and terminate repeat infringers.

WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT IT WILL MEET YOUR NEEDS OR EXPECTATIONS.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY OR ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL THE COMPANY'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED ONE HUNDRED U.S. DOLLARS ($100). You agree to defend, indemnify, and hold harmless the Company and its affiliates, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your UGC, your use of the Service, your breach of these Terms, your violation of any law or the rights of a third party, or any information we provide to law enforcement in connection with your use of the Service.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Except for disputes relating to intellectual property, you and the Company agree to first attempt to resolve any dispute informally by contacting us through our support page. If a dispute is not resolved within sixty (60) days, either party may submit the dispute to final and binding individual arbitration, rather than in court, except that either party may bring a qualifying claim in small claims court.
CLASS ACTION WAIVER. To the extent permitted by law, you and the Company waive the right to bring or participate in any class, consolidated, representative, collective, or private attorney general action. Disputes must be brought in each party's individual capacity. If this class action waiver is found to be unenforceable as to a particular claim, then that claim shall be severed and brought in court, while all other claims remain subject to arbitration.
JURY WAIVER. To the extent permitted by law, the parties waive any right to a jury trial in connection with any dispute arising out of or relating to these Terms.
RIGHT TO OPT OUT. You may opt out of these arbitration and class action waiver provisions within thirty (30) days of first accepting these Terms by sending us notice of your decision through our support page, including your name and the email address associated with your account. If you opt out, neither you nor the Company will be bound by the arbitration or class action waiver provisions; all other parts of these Terms continue to apply.
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws principles, except that the arbitration provisions are governed by the Federal Arbitration Act. For any claim that is not subject to arbitration (including claims for injunctive relief relating to intellectual property), you and the Company agree to the exclusive jurisdiction of, and venue in, the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
When you use the Service, you consent to receive communications from us electronically, and you agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that they be in writing. You agree that any time you electronically agree or consent through the Service, it constitutes your electronic signature, which binds you as if you had signed on paper.
We control and operate the Service from the United States and make no representation that it is appropriate or available for use in other locations. If any provision of these Terms is found invalid or unenforceable, that provision will be severed and the remainder will remain in full force and effect. We may assign our rights and obligations under these Terms at any time without notice; you may not assign yours without our prior written consent. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements. Our failure to enforce any provision is not a waiver of that provision. Any provision that by its nature should survive termination of your access to the Service will survive, including the license you grant in your content, the Release, and the indemnity, disclaimer, limitation of liability, and dispute resolution provisions.
